These Terms of Service ("Terms") govern your use of the Waterly mobile app ("Waterly", "we", "us"). By downloading or using Waterly, you agree to these Terms. If you do not agree, please do not use the app.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Waterly for your own personal, non-commercial use, subject to these Terms and the app store's rules.

2. Health disclaimer

Daily hydration goals shown in Waterly are general estimates and may not be right for you. Individual hydration needs vary and can be affected by health conditions, medications, pregnancy, climate, and activity. Always use your own judgment and consult a qualified healthcare professional before making decisions about your health or fluid intake. Do not rely on Waterly in any medical emergency.

3. Subscriptions and billing

• Waterly offers an optional premium subscription ("Waterly Premium") with additional features.
• Subscriptions are billed through your Apple App Store or Google Play account at the price shown at purchase (prices may vary by region).
• Unless canceled at least 24 hours before the end of the current period, subscriptions renew automatically, and your account is charged for the next period.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription, and the trial converts to a paid subscription unless canceled before it ends.
• You can manage or cancel your subscription any time in your App Store or Google Play account settings.
• Refunds are handled by Apple or Google according to their policies; we generally cannot issue refunds directly.

4. Acceptable use

You agree not to misuse Waterly, including attempting to reverse engineer, decompile, interfere with, or gain unauthorized access to the app or its systems, or to use it in any unlawful way.

5. Intellectual property

Waterly and its content, design, and trademarks are owned by LE VAN ANH and are protected by law. These Terms do not grant you any rights to our trademarks or branding.

6. Disclaimer of warranties

Waterly is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or accurate.

7. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of Waterly.

8. Termination

You may stop using Waterly at any time by deleting the app. We may suspend or terminate access if you violate these Terms.

9. Apple App Store

If you obtained Waterly from the Apple App Store, you acknowledge that these Terms are between you and us only, not with Apple, and that Apple is not responsible for the app or its support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10. Governing law

These Terms are governed by the laws of Viet Nam, without regard to conflict-of-law principles.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of Waterly after changes means you accept the updated Terms.
